Agreement to Terms and Conditions
This document sets out the terms and conditions of membership of the Health Care Plans. By completing and submitting your chosen Health Care Plan you confirm that you are the legal owner of the pet listed on your registration form and that you wish to enter into a contract for membership of the Health Care Plans with London Animal Care Limited, trading as Vet in the City (“The Company”, “Vet in the City”, “we”, “us” or “our”) subject to these terms and conditions.
We are registered in England and Wales under number 7614145. Our registered office is at 375-377 Roman Road, E35QR, London, UK.
Please read the terms and conditions carefully. If you have questions concerning these terms or any aspect of our service, you are required to raise these questions with Vet in the City prior to completing your registration.
Health Care Plans Terms and Conditions are to be read in conjunction with General Terms and conditions of the Vet in the City practice. By accepting these terms and conditions you also agree to accept the General Terms and conditions found on our website.
Changes to the Agreements
We reserve the right, from time to time, with or without notice to you, to change these Terms and Conditions at our sole discretion. The Terms and Conditions applicable to your access to and use of this website will be the version that is current and displayed on the website as at each date you access the website.
Instructions
We cannot accept instructions from anybody under the age of 18 years. We understand that requests may be made by persons acting as your agent, such as pet carer, doggy day-care owner, kennel owner. It is assumed, unless advised in writing by yourself, that they have your authority and are acting in your interest and on your behalf. Requests for account details to be changed must be made in writing by the account holder.
1. Health Plans are an annual preventative healthcare programme. They are not an
insurance policy.
2. Membership of the agreement constitutes an agreement between you and Vet In
The City. Membership and benefits are not transferable to another practice.
3. You will receive discounted products and services during the course of your
membership, including, but not limited to vaccines and flea / worming treatments
and may include consultations with our vets and/or nurses. Full details of what is
included is listed on our website.
4. The fee for your pet will be determined by its species and in some cases weight.
Of course, your pet can still receive treatment outside the scope of the Health Plans
and this will be charged in accordance with the practice’s normal fees and terms and
conditions.
5. Health Care Plan terms and conditions should be read in conjunction with any
additional information including, but not limited to, literature provided by the
practice detailing what is included in the Health Plans. That literature forms part of
these terms and conditions.
7. Your responsibilities – you are responsible for following our vets’ and nurses’
guidance, and for ensuring your pet attends the practice regularly (a minimum of
Once a year) for the preventative healthcare checks which are included as part of your
membership of our Health Care Plans. If we are unable to maintain your pet’s health
because you haven’t followed guidance or attended the practice we may need to
terminate your membership. Termination would be in writing as outlined below, and
with immediate effect.
It is your responsibility to ensure your current account has sufficient funds to pay the charges. We shall not be responsible for any additional charges which may be imposed on you by your bank or card issuer. On termination of the Contract for any reason you shall immediately pay us all of Vet in the City’s outstanding unpaid invoices and interest and, in respect of services supplied but for which no invoice has been submitted, we shall submit an invoice, which shall be payable by you immediately on receipt.
8. Your membership fees will be collected by subscription on a monthly basis.
9. We use Wix Payments to collect payments on our behalf. Payment references to your monthly charges will appear on your bank statement as a payment to Wix payments with reference “VET IN THE CITY”. For the avoidance of doubt, your
agreement is solely with Vet in the City and Wix is a payment collection support system to the practice. By signing up to Vet in the City’s Health Care Plan you are also agreeing to Wix payment's terms and conditions.
10. The membership of each pet registered on our Health Care Plans will renew on the
anniversary of the date that the pet joined the Health Care Plan.
11. We will tell you in advance, in writing, if there is to be a change in membership fees
on the renewal date. We will always give you at least 30 days notice of any change in
fees as a result of our annual review.
12. Each Health Plan includes the following:
12.1 Basic Health Care Plans

Microchipping
-
Routine parasite control (for fleas, worms +/- ticks) as appropriate for the individual pet, as advised by the consulting veterinary surgeon. Additional treatments (e.g. for pets that travel abroad) may not be included.

Annual vaccination as deemed necessary and appropriate for the individual pet by the consulting veterinary surgeon (limited to vaccination against the following diseases - for dogs - distemper, viral hepatitis, parainfluenza, parvo virus, leptospirosis and kennel cough; for cats - feline herpes virus, feline calicivirus, feline panleukopaenia virus, feline leukaemia virus). For the avoidance of doubt, among others, rabies vaccinations are not included in the Health Care Plan and, if needed, must be purchased separately.

A 5% discount off of the full list price of neutering and dental operations conducted at Vet in the City

ONE free of charge veterinary. To be eligible for inclusion in this part of the plan, the consultation must be taken during normal consulting hours, must be conducted at Vet in the City, 375-377, Roman Rd, Bow, London E3 5QR and must be with a first opinion veterinarysurgeon or nurse. Consultations outside of normal consulting hours, off site or consultations with a referral veterinary surgeon or paraprofessional (e.g. physiotherapist, ultrasonographer, referral surgeon etc.) will be charged at normal list price. For the avoidance of doubt, procedures, medication and tests conducted as part of, or outside of the consultation will usually not be included in the Health Plan and will be charged at their normal list price.
12.2 Premium Health Care Plans

A 10% discount off of the full list neutering and dental operations conducted at Vet in the City

Free of charge veterinary or nurse consultations. To be eligible for inclusion in his part of the plan, the consultation must be taken during normal consulting hours, must be conducted at Vet in the City, 375-377, Roman Rd, Bow, London E3 5QR and must be with a first opinion veterinary surgeon or nurse. Consultations outside of normal consulting hours, off site or consultations with a referral veterinary surgeon or paraprofessional (e.g. physiotherapist, ultrasonographer, referral surgeon etc.) will be charged at normal list price. For the avoidance of doubt, procedures, medication and tests conducted as part of, or outside of the consultation will usually not be included in the Health Plan and will be charged at their normal list price.
13. If your Health Care Plan membership is cancelled automatically because of failed direct debits, your account will be reviewed and will be charged the full price of any
products and services received during the course of your membership, minus any
membership fees received to date.
14. Unpaid bills relating to your membership fees, treatment received or medicines
dispensed will be handled in accordance with our standard terms and conditions
(available on request) and may be referred to a third party debt collection agency.
15. Ending our agreement / cancelling your membership:

You may cancel your membership on your anniversary date (which is the anniversary of the date you joined) by giving us not less than two weeks’ notice.

If you cancel your membership before your anniversary date, we will review your account and, where applicable, charge you retrospectively the full price of any products and services received during the course of your membership, minus any membership fees received to date.

We may end our agreement by giving you written notice as outlined below.
16. Written Communications
Applicable laws require that some of the information or communications we send to you should be in writing. When using our service, you accept that communication with us will be mainly delivered electronically through email, in-app messaging or both. We might contact you occasionally to provide you with information and updates to our service. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information, and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
With regard to this agreement, either party wishing to give notice to the other should do so in writing.
‘In writing’ includes emails, letters sent by post, or delivered by hand.
When we write to you by post, we will use the address most recently provided.

17. Complaints procedure
We aim to offer you a professional, friendly and efficient service and we hope that you will be pleased with the work we do for you. However, should a difficulty arise, our approach is to be constructive. Every complaint will be taken seriously, will be investigated thoroughly and promptly and remedial action will be taken as appropriate. 18. Force Majeure
We will not be liable to you for any lack of performance, or the unavailability or failure of this website or our services, or for any failure by us to comply with these Terms and Conditions, where such lack, unavailability or failure arises from any cause reasonably beyond our control.
19. Transfer of Rights and Obligations
The contract between you and Vet in the City is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.
20. Intellectual Property
The content of the website, including graphics, data, information, text, images, design, logos, links, software and source code are protected by copyright, trademarks, database and other intellectual property rights. All rights, including copyright, in the content of the pages of the website are owned and controlled by us. You may retrieve and display the content of the website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy, broadcast, download, store (in any medium), show, play in public, adapt, change in any way or distribute or use for commercial purposes any of the materials or content on the website without our prior written permission.
If you post comments on the Products or Services to any website, blog or social media network (Commentary) you must ensure that such Commentary represents your fairly-held opinions. By subscribing to the Services you irrevocably authorise us to quote from your Commentary on our site and in any advertising or social media outlets which we may create or contribute to.

22. Data Protection
Vet in the City as administrators of this service, and WIX payments as data processor, take your privacy very seriously and take great care to comply with its obligations under the Data Protection Act 2018 and to protect your personal information including any financial details that you provide. We will only use your personal information to administer the Dog Daycare Plan which may include providing details to our partner day care’s. We may need to disclose or share your personal information with regulatory authorities for the purpose of fraud prevention and/or to comply with any legal or regulatory requirement.
If you have any questions about the way Vet in the City uses your personal information you can review our privacy notice or write to us. From time to time Vet in the City may wish to use the details you have provided to advise you of associated products which are important to your animal’s welfare and of potential interest as a pet owner. If you do not wish to be informed of these please notify Vet in the City of your preference by contacting us.
23. Environment
As a business we are aware of the environmental demands of modern day life and as such have instigated a number of green initiatives, including reducing the amount of paper we use.
24. Governing Law
Your use of this website is governed by these Terms and Conditions and construed and enforced in accordance with the laws of England and Wales. Disputes arising from your use of this website and the services we provide are subject to the non-exclusive jurisdiction of the courts of England and Wales.
